Terms

These terms govern your use of Elsewhere, a macOS application published by Saranyx ("we", "us"). Installing or using the software means you accept them. If you do not, do not install it, and if you have already paid, ask for a refund.
1. Your licence
We grant you a personal, non-exclusive, non-transferable licence to install and use Elsewhere on Macs you own or control, for as long as your plan is current. A licence covers one person, on their own machines, with any number of their own iPhones. It is not a site licence; for team seats or CI runners, write to us.
The free tier is licensed on the same terms, indefinitely, with the feature limits described on the site at the time.
2. What you may not do
- Redistribute, resell, sublicense, rent or publish the software, or make it available to anyone outside your own use.
- Reverse engineer, decompile or disassemble it, except to the extent that applicable law says you may despite this restriction.
- Remove or defeat the licensing mechanism, or share a licence key.
- Use it in breach of the acceptable-use policy, which forms part of these terms.
3. Acceptable use
The acceptable-use policy is binding. Breaching it terminates your licence immediately and without refund. In summary: not for fraud, not for defeating monitoring you are subject to, not for deceiving or tracking another person, and not on a device that is not yours.
4. Subscriptions, billing and cancellation
Paid plans are billed in advance through Stripe, monthly or annually, and renew automatically until cancelled. A lifetime licence is a single payment covering all future versions.
Every subscription begins with a seven-day free trial. A payment method is required to start it. Nothing is charged during the trial, and the first charge occurs at the end of day seven unless you cancel first. We email you before that happens.
Cancel at any time in the billing portal, linked from your licence email, or by writing to us. Cancellation takes effect at the end of the period you have paid for, and the app then falls back to the free tier rather than locking you out. Prices may change with at least 30 days' notice to existing subscribers, and never retroactively.
5. Refunds
Fourteen days, on everything, lifetime licences included, no reason required. See refunds. This is in addition to any statutory right of withdrawal you have where you live, which we do not attempt to limit.
6. What the software depends on
Elsewhere works by using a developer connection that Apple provides in iOS and macOS. We do not control that mechanism. Apple may change or remove it in any release, which could reduce or end the software's function on some or all devices. We will say so honestly and promptly if it happens, and we will refund recent purchases, but we cannot promise indefinite compatibility and nobody in this category can.
Elsewhere is not affiliated with, endorsed by, or sponsored by Apple Inc., nor by any app or service it may be used with.
7. No warranty
The software is provided "as is". To the fullest extent the law allows, we disclaim all implied warranties including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that it will be uninterrupted or error-free, or that any particular app or service will accept the location it sets.
8. Liability
To the fullest extent the law allows, our total liability arising out of these terms or the software is limited to the greater of the amount you paid us in the twelve months before the claim, or USD 100. We are not liable for indirect, incidental, special or consequential damages, for lost profits, or for consequences of your own use of the software, including any ban, suspension, penalty or legal consequence imposed by a service you used it with.
Nothing here excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud. If you are a consumer, you keep every statutory right you have, and where these terms conflict with those rights, those rights win.
9. Privacy
See the privacy policy. In short: no telemetry, no analytics, no account, and no location data ever leaves your Mac.
10. Termination
You may stop using the software at any time. We may terminate a licence for breach of these terms or the acceptable-use policy, with a refund only where the breach is not your fault. On termination you must stop using the software.
11. Changes to these terms
We may update these terms. Material changes are emailed to customers at least 30 days ahead, and continuing to use the software after they take effect means accepting them. If you do not accept them, cancel and, within the fourteen-day window, ask for a refund.
12. Governing law
These terms are governed by the laws of the jurisdiction in which Saranyx is established, and the courts of that jurisdiction have non-exclusive jurisdiction. If you are a consumer, this does not deprive you of the protection of the mandatory laws of your own country of residence, or of the right to bring proceedings there.
